Of course detail deliberations and discussions on the approach taken by the ulemas will need a much longer postings that I would care to or able to fully explain in such settings as FB and/or blog.
For those interested they can of course pursue to delve further under this topic elsewhere, or engage me in further discussions via Q&A instead. As obvious below, I hope - I am in no way trying to force anybody to accept blindly what I have put in here - but rather as a start to understand the issue (which should not be an issue in the first place) better. Feel free to pursue the matter in any way you deem beneficial, keeping in mind the basic parameter as mentioned in part 1.
To conclude the posting, suffice I think for me to re-produce here an excerpt from Dr Zul's blog (MP for Kuala Selangor - http://drdzul.com/2013/01/10/pas-daulatkan-islam-untuk-semua/) as below;
“Maka barulah betul (sahih) kita merujuk kemudiannya kepada kepada Qawaid Fiqqiyah setelah merujuk kepada al-Quran (cara mencari dalil atau beristidlal yang betul dalam Islam) dan tidak sebaliknya, yakni tiba-tiba haram kerana Qaedah ‘as-Sadda az-Zari’ah’ atau perhitungan menutup pintu kemudaratan, sebelum kita meneliti wujudnya Nas atau Nusus secara jelas mengenai perkara atau maudhu tersebut dalam al-Quran itu sendiri,”
“Adapun setelah diharuskan penggunaan kalimah itu, adalah mustahak dan penting untuk memastikan keharusan itu tidak disalahgunakan sama ada konteks yang tidak sesuai seperti merujuk kepada berhala, dewa atau tujuan mendi’ayah ummat Islam dalam program Kristianisasi seperti yang ditakuti atau dikhuatiri umat Islam di negara ini."
